1. Agreement to Terms

Welcome to FashionLab! These Terms of Service ("Terms") govern your access to and use of our AI-powered virtual try-on platform and services. By accessing or using FashionLab, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Important: These Terms include an arbitration agreement and class action waiver that affect your legal rights. Please read them carefully.

2. Description of Service

FashionLab provides an AI-powered virtual try-on service that allows users to:

• Upload personal photos for virtual clothing try-on
• Browse and select clothing items from our digital clothing collection
• Generate AI-created visualizations of clothing on your photos
• Save, share, and manage try-on results
• Access fashion recommendations and styling suggestions

Our service uses artificial intelligence and machine learning technology to process images and generate realistic try-on results. Results are simulations and may not perfectly represent how actual clothing would fit.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years old to use FashionLab. If you are under 18, you must have permission from a parent or legal guardian. Users under 13 are strictly prohibited from using our service.

3.2 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion.

4. User Content and Photo Uploads

4.1 Your Content

You retain all rights to photos and content you upload ("User Content"). By uploading User Content, you grant FashionLab a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of providing and improving our services.

4.2 Content Restrictions

You agree NOT to upload content that:

• Contains nudity, sexually explicit material, or pornography
• Depicts minors in inappropriate situations
• Violates intellectual property rights of others
• Contains hate speech, harassment, or discriminatory content
• Promotes violence, illegal activities, or self-harm
• Includes personal information of others without consent
• Contains malware, viruses, or malicious code

4.3 Content Monitoring

We reserve the right to review, monitor, and remove any User Content that violates these Terms. However, we are not obligated to pre-screen content and do not assume responsibility for User Content.

4.4 Rights to Photos of Others

You represent and warrant that you have all necessary rights, permissions, and consents to upload photos containing identifiable individuals. You are solely responsible for ensuring you have proper authorization.

5. AI Technology and Accuracy

5.1 AI-Generated Results

Our virtual try-on results are generated using artificial intelligence and are simulations only. These visualizations:

• Are approximations and may not be 100% accurate
• Do not guarantee how actual clothing will fit or look on you
• May contain imperfections or artifacts from AI processing
• Should not be used as sole basis for purchasing decisions

5.2 No Warranty

We do not warrant that AI-generated results will be error-free, accurate, or meet your expectations. Use of results is at your own risk.

5.3 AI Model Improvement

Your uploaded photos and generated results may be used to train and improve our AI models, always in accordance with our Privacy Policy. You can opt out of this by contacting us at support@fashionlab.ai.

6. Prohibited Uses

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or extract our AI models
• Use automated tools (bots, scrapers) to access the service
• Circumvent any security features or access restrictions
• Upload malicious code or attempt to interfere with service operation
• Impersonate others or misrepresent your affiliation
• Collect or harvest information about other users
• Use the service to create deepfakes or misleading content
• Resell, redistribute, or commercialize our service without permission
• Use results for commercial purposes without a commercial license

7. Intellectual Property Rights

7.1 Our Intellectual Property

FashionLab and all content, features, and functionality (including but not limited to software, AI models, design, text, graphics, logos) are owned by FashionLab and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our service for personal, non-commercial purposes, subject to these Terms.

7.3 Clothing Item Rights

Clothing items displayed in our collection are for visualization purposes only. We do not claim ownership of fashion designs, brands, or trademarks of third-party clothing manufacturers.

8. Payment and Subscriptions

8.1 Free and Paid Services

FashionLab may offer both free and paid subscription tiers. Paid features may include:

• Unlimited try-on generations
• Access to premium clothing collections
• Higher resolution results
• Priority AI processing
• Commercial usage rights

8.2 Billing

For paid subscriptions:

• You will be billed in advance on a recurring basis (monthly or annually)
• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days notice
• All payments are non-refundable except as required by law

8.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until then, but no refunds will be provided for partial periods.

9. Disclaimer of Warranties

Specifically, we do NOT warrant that:

• The service will be uninterrupted, timely, secure, or error-free
• Results will be accurate, reliable, or meet your expectations
• Any errors or defects will be corrected
• The service is free of viruses or harmful components
• AI-generated images represent actual clothing fit or appearance

You agree to indemnify, defend, and hold harmless FashionLab, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your User Content or photos you upload
• Your violation of any rights of others
• Your violation of any applicable laws or regulations

12. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using FashionLab, you consent to our data practices as described in the Privacy Policy.

• Your photos are stored securely and never shared publicly
• We use data to provide services and improve AI models
• You can delete your photos and account at any time
• We comply with GDPR, CCPA, and other privacy regulations

13. Third-Party Links and Services

• The availability, accuracy, or content of third-party sites
• Third-party privacy practices or terms of service
• Any damages or losses caused by third-party interactions

Your use of third-party services is at your own risk and subject to their terms.

• Modify, suspend, or discontinue any part of the service
• Add or remove features at any time
• Change pricing with 30 days advance notice
• Impose limits on usage or storage

We will attempt to notify you of material changes, but are not obligated to do so. Continued use after changes constitutes acceptance.

15. Termination

15.1 By You

You may terminate your account at any time by contacting support@fashionlab.ai or through your account settings.

15.2 By Us

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion for any reason

15.3 Effect of Termination

Upon termination: (1) your right to use the service ends immediately, (2) we may delete your account and User Content after 30 days, (3) provisions that should survive termination will remain in effect.

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before filing a claim, you agree to first contact us at legal@fashionlab.ai to attempt to resolve the dispute informally. We will work in good faith to resolve issues within 60 days.

16.2 Binding Arbitration

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except as noted below. Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Either party may bring a claim in small claims court or seek injunctive relief in court to protect intellectual property rights.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date at the top
• We will notify you via email or in-app notification
• Changes become effective 30 days after posting (or immediately for legal requirements)
• Continued use after changes constitutes acceptance

If you do not agree to the new Terms, you must stop using the service and may terminate your account.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FashionLab regarding the service.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our written consent. We may assign these Terms without restriction.

19.5 Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, or other force majeure events.
